Happy Tuesday, As we transition into August, significant changes in our industry are on the horizon. Different boards across the region and country have rolled out updates on varied timetables. With many agents holding multi-state licenses, it’s crucial to understand the distinctive differences among the new contracts, particularly in how buyer broker representation and listing agreements will be impacted. Amidst the abundance of training provided, it’s essential that all agents take the time to get educated on these changes. Unfortunately, a large percentage of agents aren’t regularly attending these sessions. As local area experts and trusted practitioners, we must stay informed. This is the third article I’ve written on this topic since the initial settlements, and while some of the information may be repetitive, it underscores the importance of these changes. We must maintain respect, clarity, and avoid ignorance. Remember, no one knows everything, and the situation remains fluid. Some contract changes in July led to confusion, necessitating further adjustments in how our listings appear in MLS systems to avoid potentially offering double compensation. Effective communication channels from brokerages to agents are vital. Agents should consistently ask questions about the evolving landscape. The contracts might change again, and more updates or addendums may emerge. It’s important not to get creative with interpretations or attempt to practice law. Instead, focus on collaboration, which will strengthen our resolve and how we treat each other. The state of the market will influence how these changes are utilized. For instance, if interest rates change, the balance between buyer and seller markets might shift, impacting how buyer broker agreements and compensations are managed. Our transaction cycle, where the buyer brings money to the table, pays the seller, and the net proceeds are split between listing and buyer broker agents, is being redefined for clarity. However, this could pose challenges for some at the closing table. Our priority must always be the best interest of consumers. The increased involvement in contracts requires us to be mindful of our roles and still prioritize consumers first. When money is involved, clarity can be lost, so it’s crucial to adhere strictly to the law and avoid over-interpretation. Listing and buyer consultations are the cornerstone of establishing your value to the consumer. Don’t rush them and don’t take them for granted. Never minimize your value. These consultations are critical in explaining the changes and ensuring that consumers understand the new landscape. They provide an opportunity to dispel any misinformation and reinforce your expertise.

Be cautious about what you say and how you present it. Respect law’s intention. Avoid creative interpretations. Utilize proper communication channels; don’t misuse MLS or showing time. Communicate directly with other agents—pick up the phone. Change will continue to happen in our industry. No matter if its market driven, technological, capital investments or greed – this time it seems to be a combination of all of those.
